By accessing, registering on, or using the 9AM platform (“9AM”, “Platform”, “we”, “us”, “our”), you (“User”, “Candidate”, “Referrer”) agree to be legally bound by these Terms & Conditions (“Terms”). If you do not agree, you must not use the Platform.
These Terms must be read together with the 9AM Privacy Policy, which is incorporated by reference.
1. Nature of the Platform
9AM is a technology-enabled hiring and referral facilitation platform.
9AM is a not:
- An employer
- A recruitment or staffing agency
- A payroll provider
- A guarantor of employment, compensation, or job continuity
9AM’s role is strictly limited to:
- Enabling discovery of candidates by companies
- Facilitating referrals, assessments, interviews, and introductions
- Generating hiring-related signals and recommendations
All hiring decisions, offers, compensation, and employment terms are determined solely by hiring companies
2. Eligibility & Mandatory Verification
- Mobile number and/or email verification is mandatory.
- 9AM may require additional verification, including identity checks, KYC, or documentation.
- Failure to verify may result in denial of access, suspension, or termination
3. Collection of Photo, Video & Identity Data
You expressly acknowledge and consent that 9AM may collect, process, store, and use:
- Photographs of users
- Video recordings
- Live or recorded video interviews
- Image/video-based identity verification data
Such data may be collected and used for:
- Interviews and interview evaluation
- Integrity and fraud checks
- Identity verification (KYC)
- Platform safety and trust
- Hiring evaluation by companies
9AM reserves the right to share such photo and video data with:
- Hiring companies
- Interview partner
- Assessment providers
- Identity verification partners
- Other authorized service providers
4. Skill Tests, Interviews & Integrity Signals
- Skill tests, interviews, assessments, and linked external profiles generate signals, not guarantees.
- Signals may be positive, neutral, or negative.
- Integrity, credibility, and risk indicators may be generated through:
- Automated systems
- AI models
- Human reviewers
- Authorized partners
9AM may share these signals with hiring companies without informing the user.
5. Referrals & Referral Programs
- Referral bonuses apply only if explicitly advertised on a job post om 9am careers.
- Referral bonuses are:
- Defined by the hiring company
- Time-bound and quantity-bound
- If not advertised, no referral bonus is payable.
Referral eligibility ends automatically when:
- The advertised number of positions is filled, or
- The referral validity period expires.
6. Referral Tracking & Personalized Links
- Referrals are tracked only via personalized referral links generated on 9AM.
- Links embed the referrer’s unique ID and the job post.
- 9AM is not responsible for untracked referrals due to incorrect usage or manual sharing.
7. Multi-Level Referral Payouts
- Multi-level referral payouts apply only if configured and paid by the hiring company.
- Splits, levels, and eligibility may change at any time.
- 9AM will pay referral bonuses only if and to the extent the company pays 9AM.
- If the company does not pay, 9AM has no obligation to pay referrers.
8. Payments, Taxes & Compliance
- All payouts are subject to:
- Candidate joining confirmation and other conditions set by company or 9am careers
- Company payment to 9AM
- PAN submission and verification
- Applicable taxes and statutory deductions apply.
- 9AM may withhold or reverse payouts for disputes, fraud, or compliance reasons.
9. Joining Bonuses
- Joining bonuses apply only if explicitly advertised by the hiring company on 9am careers and candidate joins the company within the specified date as complies with other conditions specified by company.
- Eligibility, timelines, and conditions are company-defined.
- 9AM does not guarantee or enforce joining bonus payments unless explicitly stated.
10. Misrepresentation, Fraud & Integrity Violations
Any misrepresentation or falsification of:
- Identity
- Resume or profile data
- Education or experience
- Test or interview conduct
may result in:
- Immediate disqualification
- Cancellation of referrals or bonuses
- Account suspension or termination
- Legal action by 9AM and/or the hiring company
11. Employment & Compensation Disclaimer
9AM has no responsibility for:
- Salary payments
- CTC commitments
- Offer enforcement
- Employment disputes
All employment obligations exist solely between the candidate and the hiring company.
12. Limitation of User Data Rights (DPDP Act)
To the maximum extent permitted by law, you expressly agree that:
- You do not have a right to obtain, demand, export, or access any internal platform data
- This includes, without limitation:
- Test scores
- Interview feedback
- Integrity or risk indicators
- AI-generated recommendations or rankings
- Logs, analytics, or internal assessments
Your right to access personal data is strictly limited to:
- The resume or profile information you directly provided, subject to verification and applicable law.
13. Data Usage, Sharing & Consent
By using the Platform, you provide explicit consent for:
- Processing of personal, professional, photo, video, and integrity data
- Automated and AI-based analysis
- Sharing of data with hiring companies and authorized partners
- Cross-border data transfers, as detailed in the Privacy Policy
14. Platform Integrity, Media & Public Response
In the event of:
- Public complaints
- Social media disputes
- Media inquiries or allegations
9AM reserves the right to:
- Use platform records, data, logs, integrity data, photos, or videos
- Clarify facts publicly or privately
- Defend its reputation and legal interests
Such actions shall not constitute a breach of privacy or confidentiality.
15. Indemnity
You agree to indemnify and hold harmless 9AM, its founders, directors, employees, partners, and affiliates from any claims, losses, damages, liabilities, or expenses arising from:
- Misrepresentation or fraud
- Violation of these Terms
- Disputes with companies or other users
- Public statements or conduct attributable to you
16. Limitation of Liability
9AM shall not be liable for:
- Hiring outcomes
- Salary or employment disputes
- Missed opportunities
- Company actions
- Data inaccuracies
- Platform downtime
17. Dispute Resolution & Arbitration
All disputes shall be resolved by binding arbitration in Hyderabad, Telangana, under the Arbitration and Conciliation Act, 1996.
- Sole arbitrator appointed by 9AM
- Proceedings in English
- Award final and binding
18. Fallback Jurisdiction
9AM may seek injunctive or interim relief for fraud, data misuse, or platform abuse before the High Court of Telangana, which shall have exclusive jurisdiction.
19. Children’s Use
The Platform is not intended for individuals under 18 years of age.
9AM does not knowingly permit minors to use the Platform.
20. Modifications & Acceptance
9AM may update these Terms at any time.
Continued use constitutes acceptance of updated Terms.
21. Governing Law
These Terms are governed by the laws of India.
